SUBJECT: Fiscal Note for SB 260 by Senate Committee on Ways and Means
In accordance with KSA 75-3715a, the following fiscal note concerning SB 260 is
respectfully submitted to your committee.
SB 260 would require any candidate or officer holder upon written request from an
individual or organization to remove endorsements of that individual or organization from the
candidate or officer holder’s website and all social media within 90 days of the receipt of the
request. A candidate or office holder who violates the above provision would be liable for a civil
penalty of $500 for each violation.
The Kansas Governmental Ethics Commission states the Commission at times does not
assess penalties or fines in scenarios where a candidate has attempted to comply in good faith and
corrected the error once notified. Additionally, the Commission indicates it does not know how
often a violation of the bill’s provisions would occur. According to the Commission, enactment
of SB 260 would have a negligible fiscal effect on agency operations.
