Dear Senator Billinger:
SUBJECT: Fiscal Note for SB 232 by Senate Committee on Education
In accordance with KSA 75-3715a, the following fiscal note concerning SB 232 is
respectfully submitted to your committee.
SB 232 would require the Director of the Budget, in both FY 2021 and FY 2022, to identify
any federal coronavirus relief funds received by any state agency that “may be expended at the
discretion of the state.” The Director of the Budget would be required to certify any amounts by
fund determined to be “discretionary” to the Director of Accounts and Reports, as well as to the
Director of Legislative Research. If the amount certified is greater than $5.0 million, the Director
of Accounts and Reports would transfer $5.0 million of the amount certified from the identified
federal funds to the COVID-19 Hazard Pay for Teacher Fund. The fund would be appropriated
by the bill with a “no-limit appropriation” in both FY 2021 and FY 2022. The Department of
Education would distribute any available monies in the fund to eligible teachers, as determined by
the agency.
The Division of the Budget indicates that SB 232 could be implemented with the agency’s
existing staff and budget. Any funds distributed to eligible teachers by the Department of
Education would depend on if sufficient discretionary coronavirus relief federal funds are
identified by the Director of the Budget with an aggregate total of greater than $5.0 million. Any
fiscal effect associated with SB 232 is not reflected in The FY 2022 Governor’s Budget Report.
