SUBJECT: Fiscal Note for HB 2323 by Representatives Woodard, Byers and S. Ruiz
In accordance with KSA 75-3715a, the following fiscal note concerning HB 2323 is
respectfully submitted to your committee.
HB 2323 would amend current law by removing the term “who are of opposite sex” when
defining who is a party to a marriage contract. The bill would replace the term “take each other as
husband and wife” and replace it with “desire to be married.” The bill would also remove the term
“it is the strong public policy of this state only to recognize as valid marriages from other states
that are between a man and a woman.”
According to the Office of Judicial Administration, enactment of HB 2323 would not have
a fiscal effect on the operations of the Judicial Branch.
