SUBJECT: Fiscal Note for HB 2310 by Representative Xu
In accordance with KSA 75-3715a, the following fiscal note concerning HB 2310 is
respectfully submitted to your committee.
HB 2310 would amend existing law to create the Kansas Healthy Soils Initiative for the
purposes of promoting healthy soils in Kansas. The bill addresses improper land-use practices of
farm and grazing lands in the state, the consequences of those practices and the appropriate
corrective methods. The bill declares that it would be the policy of the Legislature to provide for
the conservation, health, restoration, use and development of the soil and water resources of the
state and defines “healthy soils practices.” The bill would establish procedures within the State
Conservation Commission to ensure healthy soils and would create the Healthy Soils Fund in the
State Treasury to be administered by the Kansas Department of Agriculture. Receipts to the fund
would include appropriations, gifts, grants or private contributions. The Secretary of Agriculture
would be prohibited from using more than 5.0 percent of the monies in the fund for administrative
costs and would be required to use 95.0 percent of the monies to provide funding to healthy soils
programs.
The Kansas Department of Agriculture is unable to estimate expenditures or revenues that
might result from enactment of HB 2310, as it is impossible to determine what revenue would be
provided to the program through appropriations or donations. Any fiscal effect associated with
HB 2310 is not reflected in The FY 2022 Governor’s Budget Report.
