SUBJECT: Fiscal Note for SB 162 by Senate Committee on Commerce
In accordance with KSA 75-3715a, the following fiscal note concerning SB 162 is
respectfully submitted to your committee.
SB 162 would expand the Employment Security Board of Review from three members to
six members until June 30, 2024. No more than four members of the new six-member board could
belong to the same political party. After June 30, 2024, the Board would return to three members.
The bill would authorize the Board to sit in panels for the purposes of hearing and determining
cases. A panel would consist of three members. The bill would amend provisions regarding
member term limits. The Board or panel of the Board would be authorized the discretion to deny
a request for an in-person hearing in the absence of good cause shown by the party requesting the
hearing. The bill would become effective upon its publication in the Kansas Register.

The Kansas Department of Labor estimates that increasing the Board by three members
would require additional expenditures of $13,324 from federal funds for one quarter of FY 2021

and $53,295 for FY 2022. The estimate is based upon $45,000 for the salaries and wages for the
new Board members ($15,000 for each member) plus $8,295 for travel expenses. Any fiscal effect
associated with SB 162 is not reflected in The FY 2022 Governor’s Budget Report.
