SUBJECT: Fiscal Note for SB 169 by Senate Committee on Ways and Means
In accordance with KSA 75-3715a, the following fiscal note concerning SB 169 is
respectfully submitted to your committee.
SB 169 would allow the Legislative Coordinating Council (LCC) to adopt a policy
prohibiting the carrying of concealed handguns in the State Capitol, as long as the LCC has
determined that the State Capitol has adequate security measures to ensure that no weapons are
permitted to be carried into the building. The policy would specify the dates that the prohibition
would commence and terminate. Any policy could exempt law enforcement officers or members
of the US military or Kansas National Guard who are engaged in the performance of their duties.
No policy would prohibit the possession of a handgun in a vehicle located in the parking lot or
parking structure designated for motor vehicles.
According to Legislative Administrative Services, the enactment of SB 169 would have no
fiscal effect. The Office of Judicial Administration indicates the bill could expand the number of
unlawful possession of firearm cases, which would result in additional time spent by judges and
court staff on those cases. However, a fiscal effect cannot be estimated. Any fiscal effect
associated with SB 169 is not reflected in The FY 2022 Governor’s Budget Report.
