SUBJECT: Fiscal Note for HB 2257 by House Committee on Health and Human
Services
In accordance with KSA 75-3715a, the following fiscal note concerning HB 2257 is
respectfully submitted to your committee.
HB 2257 would provide for physicians to give patients information which is in the
physician’s reasonable professional medical judgment, medically accurate and appropriate for the
patient or provide a medical service in a manner that is evidence-based and appropriate for the
patient. The bill would also provide that a physician cannot be required to provide a patient
information or medical care which is not in the physician’s reasonable judgment medically
accurate, evidence-based, and appropriate for the patient.
The Board of Healing Arts states that HB 2257 could result in increased complaints and
investigations; however, the Board has no mechanism to measure how many new complaints and
investigation passage of this bill may generate. The agency estimates it would require minimal
additional work effort which could be managed within existing resources.
The Health Care Stabilization Fund Board states that the bill could potentially create
additional medical liability for a health care provider. Any fiscal effect associated with HB 2257
is not reflected in The FY 2022 Governor’s Budget Report.
