Dear Representative Williams:
SUBJECT: Fiscal Note for HB 2269 by House Committee on K-12 Education Budget
In accordance with KSA 75-3715a, the following fiscal note concerning HB 2269 is
respectfully submitted to your committee.
Under the current school finance law, the at-risk weighting is based upon the number of
students who are eligible for free meals under the National School Lunch Act. HB 2269 would
change this definition to include only students who are enrolled in kindergarten through grade
three who are eligible for free meals under the National School Lunch Act and who are enrolled
in grades four through 12 and failed to meet the proficiency standards on the most recent math or
English language arts assessments. The current at-risk formula weighting would remain at 0.484.
According to the Department of Education, the enactment of HB 2269 would increase the
number of students qualifying for the at-risk weighting from 172,000 to 301,700 FTE students, or
an increase of 129,700 FTE students. Using the at-risk weighting of 0.484 with the approved FY
2022 Base Aid for Student Excellence (BASE) of $4,706, additional State Foundation Aid totaling
$295,418,208 would be required, all from the State General Fund (129,700 FTE students X 0.484
weighting X $4,706 BASE = $295,418,208). In addition, the Department notes that there would
be an increase for state aid for the high-density at-risk weighting, which is calculated based on the
density of at-risk students in school districts. However, the Department states that a fiscal effect
estimate cannot be made, as the Department cannot determine in which districts the qualifying
students would reside. Any fiscal effect associated with HB 2269 is not reflected in The FY 2022
Governor’s Budget Report.
