SUBJECT: Fiscal Note for HB 2233 by House Committee on Local Government
In accordance with KSA 75-3715a, the following fiscal note concerning HB 2233 is
respectfully submitted to your committee.
HB 2233 would create the Municipal Historic Building Act. The Act would prohibit any
city from selling, destroying, demolishing, disposing of or otherwise alienating any public building
that is more than 80,000 square feet in size and has been placed on the National Register of Historic
Places without first obtaining the approval by a majority vote of all of the qualified electors voting
at the next scheduled general election. The city would be required to pay all costs related to the
placement of the question for approval on the ballot, which would be phrased as follows: “Shall
the City of , Kansas, sell, destroy, demolish, dispose of or otherwise alienate any public
building with a commonly known address of .” This Act would take effect and be
in force from and after its publication in the statute book.
The League of Kansas Municipalities indicates HB 2233 would increase expenditures for
cities for the costs of placing the question of selling, destroying, demolishing, or disposing of a
public building on a public ballot. The League notes that if a city could not absorb the costs of
implementing the bill within its existing resources, it could result in increased property taxes.
