Dear Representative Landwehr:
SUBJECT: Fiscal Note for HB 2207 by House Committee on Health and Human Services
In accordance with KSA 75-3715a, the following fiscal note concerning HB 2207 is
respectfully submitted to your committee.
HB 2207 would prohibit individuals licensed by the Board of Healing Arts, the Board of
Nursing, and the Behavioral Sciences Regulatory Board from performing “conversion therapy” on
any person under 18 years of age. If any licensee were to perform conversion therapy on a person
under 18 years of age, the act would constitute unprofessional conduct and would be subject to
discipline by the licensee’s regulatory board. The new restrictions would not apply to religious
leaders or an official of any religious denomination if the therapy is part of the leader’s or official’s
religious duties and is not performed under a license issued by any of the above licensing entities.
The Board of Nursing indicates that enactment of HB 2207 would require revision of the
Board’s regulations, which would need to be published in the Kansas Register at a cost of less than
$2,000 from the Nursing Fee Fund in FY 2021.
The Behavioral Sciences Regulatory Board indicates that the bill would have a negligible
fiscal effect on expenditures that would be absorbed within the Board’s existing budget. The Office
of Judicial Administration and the Board of Healing Arts indicate that HB 2207 would have no fiscal
effect on agency operations. Any fiscal effect associated with HB 2207 is not reflected in The FY
2022 Governor’s Budget Report.
