Dear Representative Waymaster:
SUBJECT: Fiscal Note for HB 2188 by House Committee on Appropriations
In accordance with KSA 75-3715a, the following fiscal note concerning HB 2188 is
respectfully submitted to your committee.
HB 2188 would require certain state information technology projects to be reviewed by the
Joint Committee on Information Technology (JCIT). Prior to entering into a contract, state
agencies must submit information concerning the project and contract to the JCIT for review.
The Office of Information Technology Services (OITS) states enactment of HB 2188
would not directly increase costs to OITS but would increase project costs for agencies that are
required to complete the appropriate paperwork with OITS.
The Kansas Department of Health and Environment cannot estimate a fiscal effect without
knowing further details on the approval process and the related time frames. The Kansas
Department of Labor states enactment of the bill could delay implementation of hardware and
software; however, the agency estimates there would be no fiscal effect on agency operations.
The Kansas Department of Transportation states enactment of the bill would require the
agency to commit additional time to the development and execution of a contract, as the
requirements of the bill would create an additional step in the contractor engagement process;
however, KDOT estimates any fiscal effect could be absorbed within existing resources.

The Department for Children and Families and the Department for Aging and Disability
Services both indicate enactment of the bill could result in additional expenditures if information
technology projects are not approved in a timely manner. Any fiscal effect associated with HB
2188 is not reflected in The FY 2022 Governor’s Budget Report.
