SUPPLEMENTAL NOTE ON SENATE BILL NO. 89

Brief*
SB 89, as amended, would amend law on securing
loads on vehicles to create an exemption for trucks, trailers,
or semitrailers when hauling agricultural forage commodities
intrastate from the place of production to a market or place of
storage or from a place of storage to a place of use. The bill
would state this exemption would not apply to trucks, trailers,
or semitrailers hauling hay bales or other packaged or
bundled forage commodities. Continuing law requires
securing a load on a vehicle so as to prevent any of this load
from dropping, sifting, leaking, or otherwise escaping.
Background
The bill was introduced by the Senate Committee on
Agriculture and Natural Resources at the request of Senator
Doll.

In the Senate Committee hearing, proponent testimony
was provided by the Director of the Stockgrowers Division,
Kansas Livestock Association, who stated agricultural forage
commodities are often high in moisture and as such, the

product forms a cohesive bond that often holds the foliage
together, making it unlikely for the product to blow out of a
truck or trailer. He also stated it is unfeasible to tarp trucks
hauling the agricultural forage commodities, as traditional
rollover tarps do not fit the size and back end of the trucks.

House Committee on Agriculture
In the House Committee hearing, proponent testimony

The House Committee amended the bill to add an
exclusion for trucks, trailers, or semitrailers when hauling
agricultural forage commodities intrastate from a place of
storage to a place of use.
Fiscal Information
According to the fiscal note prepared by the Division of
the Budget on the bill as introduced, the Department of
Transportation indicates enactment of the bill would have no
fiscal effect on the agency.
