SUPPLEMENTAL NOTE ON HOUSE BILL NO. 2165

Brief*
HB 2165, as amended, would amend the definition of an
antique vehicle for purposes of vehicle registration.
An antique vehicle is defined as a vehicle, including an
antique military vehicle, that is more than 35 years old. The
bill would add that the age of the vehicle would be determined
regardless of the age or type of the components or equipment
installed on the vehicle.
The bill also would make technical amendments.

Background
The bill was introduced by the House Committee on
Transportation at the request of Representative Delperdang.
[Note: HB 2165, as introduced, contained provisions
identical to those of 2020 HB 2528, as passed by the House.]

House Committee on Transportation
In the House Committee hearing on February 3, 2021,
Representative Delperdang, a representative of Kansas Car
Shows, LLC, and a private citizen provided proponent
testimony. The proponents stated the current definition of an
antique vehicle requires all parts be those originally

manufactured for the vehicle, and many newer and upgraded
parts are placed on older vehicles for safety and aesthetic
purposes. It also was stated certain vehicles fall into neither
the antique nor street rod categories.
No other testimony was provided.
The House Committee amended the bill to remove
references to street rod vehicles. It was stated a vehicle that
has been classified as a street rod vehicle would become an
antique vehicle for registration purposes.
[Note: The one-time registration fee for an antique
vehicle is $40 (KSA 2020 Supp. 8-172). An annual tax
registration fee of $5 also applies (KSA 2020 Supp. 8-167).
The annual registration fee for a special interest vehicle is
$26 (KSA 8-195).]

Senate Committee on Transportation
In the Senate Committee hearing on March 18, 2021,
Representative Delperdang and a representative of Kansas
Car Shows, LLC, provided proponent testimony, including
information on vehicle safety and fees. Representative
Delperdang requested removal of the House Committee
amendments, to keep street rods as a separate category for
registration purposes. No other testimony was provided.
The Senate Committee amended the bill to remove the
House Committee amendments.

Fiscal Information
According to the fiscal note prepared by the Division of
the Budget on the bill as introduced, the Kansas Department
of Revenue (KDOR) indicates an additional 68,444 currently
registered vehicles could be registered as antique, for which
registration fees are lower. According to the Division of

Vehicles, KDOR, 113 vehicles were registered as street rods
in 2020. KDOR estimates the average annual loss of revenue
to the State Highway Fund to be $1.9 million if the bill is
enacted. In addition, KDOR estimates enactment of the bill
would increase administrative expenses by $1,432 to update
policy and procedures. Any fiscal effect associated with the
bill is not reflected in The FY 2022 Governor’s Budget Report.
