SUPPLEMENTAL NOTE ON HOUSE BILL NO. 2145

Brief*
HB 2145 would exempt from the definition of “public
utility” the marketing and sale of electricity purchased through
a retail electric supplier in such supplier’s certified service
territory for the sole purpose of the provision of electric
vehicle charging services to an end user.
The bill would also make technical amendments.

Background
The bill was introduced by the House Committee on
Energy, Utilities and Telecommunications at the request of
Fuel True Independent Energy and Convenience.
[Note: The provisions of HB 2145 are the same as those
of 2020 HB 2585, as introduced. Senate Sub. for HB 2585, as
enacted, did not contain this subject matter.]

In the House Committee hearing, representatives of
ChargePoint, Department of the Army, Kansas Corporation
Commission (KCC), and Triplett, Inc., provided proponent
testimony on the bill. The proponents generally stated the bill
would allow electric vehicle charging services to be placed at

traditional businesses, foster retail competition, provide more
regulatory certainty to price charging services, and increase
access to such services.
Written-only proponent testimony was provided by
representatives of the Citizens’ Utility Ratepayer Board, EV
Build, Evergy, Kansas Electric Cooperatives, Inc., and
Metropolitan Energy Center.
No neutral or opponent testimony was provided.
According to the fiscal note prepared by the Division of
the Budget on the bill, the KCC indicated enactment of the bill
would have no fiscal effect on the agency.
