SUPPLEMENTAL NOTE ON SENATE BILL NO. 39
As Amended by House Committee of the Whole

Brief*
SB 39 would change several license, bond, and permit
renewal fee deadlines related to livestock and domestic
animals from June 30 to September 30 of each year. The bill
would also allow the Animal Health Commissioner
(Commissioner), Kansas Department of Agriculture (KDA), to
recover the actual cost of official calfhood vaccination tags. In
addition, the bill would make technical changes.

Renewal Fee Deadline Changes
The bill would change the renewal fee deadline for the
following licenses, bonds, and permits from June 30 to
September 30 of each year:
● Licenses and bonds to operate public livestock
markets and electronic auctions (Sections 1 and 2);
● Licenses and permits pertaining to the disposal of
dead animals (Section 3);
● Licenses to operate a feedlot (Section 4);
● Licenses to operate as a livestock dealer (Section
5); and
● Permits issued pertaining to the possession of
domesticated deer (Section 6).

Official Calfhood Vaccination Tags
The bill would authorize the Commissioner to require
reimbursement for the actual cost of official calfhood
vaccination tags and to charge a processing fee not
exceeding $0.20 per tag. The Commissioner would be
required to determine the processing fee on an annual basis.

Effective Date
The bill would be in effect upon publication in the
Kansas Register.

Background
The bill was introduced by the Senate Committee on
Agriculture and Natural Resources at the request of the KDA.

Senate Committee on Agriculture and Natural Resources
In the Senate Committee hearing, the Assistant Animal
Health Commissioner (Assistant Commissioner), KDA,
provided proponent testimony, stating the bill would make
the renewal date consistent with that of other agency
programs. He noted the KDA has been utilizing the
September 30 renewal date via a budget proviso for several
years. The Assistant Commissioner also stated the KDA now
offers radio frequency identification (RFID) tags for official
calfhood vaccination tags that promote disease traceability.
He stated the bill addresses the technology advancement of
RFID tags and their associated cost.

The Senate Committee recommended the bill be placed
on the Consent Calendar.

House Committee on Agriculture
In the House Committee hearing, the Assistant Animal
Health Commissioner, KDA, provided proponent testimony.
No other testimony was provided.

House Committee of the Whole
The House Committee of the Whole amended the bill to
decrease the maximum amount the KDA could charge for a
tag processing fee from $0.25 to $0.20.

Fiscal Information
According to the fiscal note prepared by the Division of
the Budget on the bill, the KDA states a change to the date
that annual license fees are paid would have no fiscal effect
on the agency. Enactment of the bill would allow the agency
to include an administrative fee for shipping and handling
charges in the applicable rules and regulations. The agency
plans for the administrative fee to be $0.15 per tag. Based on
the number of tags shipped in calendar year 2019, the
agency estimates receipts from the shipping and handling
charge to be $940 ($0.15 x 6,265 tags). This amount would
be used to offset current expenditures for shipping. Any fiscal
effect associated with the bill is not reflected in The FY 2022
Governor’s Budget Report.
