SUPPLEMENTAL NOTE ON HOUSE BILL NO. 2083

Corrections and Juvenile Justice

Brief*
HB 2083, as amended, would amend law regarding
membership of the Kansas Sentencing Commission
(Commission) to require Kansas Senate members appointed
to the Commission to also serve on the Senate Committee on
Judiciary and Kansas House of Representatives members
appointed to the Commission to also serve on the House
Committee on Corrections and Juvenile Justice.
Current law requires the Senate President, the Minority
Leader of the Senate, the Speaker of the House of
Representatives, and the Minority Leader of the House of
Representatives to each appoint one of the four members
from their respective chambers and does not specify a
committee membership requirement.
The provisions of the bill would become effective
January 9, 2023.

Background
The bill was introduced on January 20, 2021 by the
House Committee on Corrections and Juvenile Justice at the
request of the Kansas Sentencing Commission.

2020 HB 2493, as recommended by the House Committee on
Corrections and Juvenile Justice.]

House Committee on Corrections and Juvenile Justice
In the House Committee hearing on February 3, 2021, a
representative of the Kansas Sentencing Commission
testified as a proponent of the bill indicating members of the
Commission that are also members of the House Committee
on Corrections and Juvenile Justice and the Senate
Committee on Judiciary could better advocate or articulate
the position of the Commission. No other testimony was
provided.
The House Committee amended the bill to change the
effective date from publication in the statute book to January
9, 2023.

Fiscal Information
According to the fiscal note prepared by the Division of
Budget on the bill, as introduced, the Commission and the
Legislative Coordinating Council both indicate enactment of
the bill would have no fiscal effect.
According to the prison bed impact assessment
prepared by the Commission, the bill, as introduced, would
have no impact on prison admissions.
