1 A RESOLUTION relating to the rules of the House of Representatives
2 for 2019-2020; amending Rules 101, 701, 1302, 1304, 1306, 1307,
3 3903 and 3906; and revoking Rule 2110.
4 Be it resolved by the House of Representatives of the State of Kansas:
5 That the following Rules be amended to read as follows:
6 Rule 101. Time of Meeting. The hour of meeting on the first day of
7 each regular session shall be at 2:00 p.m., and on other days, shall be the
8 hour set at adjournment on the previous legislative day except that if no
9 hour of meeting is set at adjournment on the previous legislative day, the
10 hour of meeting shall be 11:00 a.m. No hour of meeting on any day of the
11 session shall be set prior to 8:00 a.m., and no meeting on any day of the
12 session may continue after 12 midnight, except when a question that was
13 taken up prior to 11:00 p.m. is under consideration, the meeting may
14 continue until the question is disposed. No meeting may take place
15 between the hours of 12 midnight and 8:00 a.m. on any day of the
16 session.
17 Rule 701. Introduction of House Bills and Resolutions. Every
18 House bill or resolution intended to be introduced shall be delivered to
19 the chief clerk. Such bill or resolution shall contain the name of the
20 legislator or the committee that is the sponsor of the legislation and the
21 person, state or local agency, organization or entity that requested the
22 bill for introduction by the legislator or committee. The delivery shall be
23 by a legislator who is a sponsor of the legislation or by a legislator who is
24 the chairperson or vice chairperson of a legislative committee that has
25 authorized the introduction, or by a legislative staff person or another
26 member of the House authorized by such legislator. In lieu of
27 introduction as provided by this rule, introduction may be as provided by
28 law for prefiled bills and resolutions.
29 Rule 1302. Notice and Agenda for Committee Meetings. The
30 chairperson shall provide notice of meetings and an agenda or agenda
31 information to committee members, the chief clerk and the public. The
32 chairperson shall include on the agenda and hold a hearing on any bill
33 for which a motion has been approved by a two-thirds majority of the
34 committee to hold such hearing. The chief clerk shall include in the
35 calendar such information as is practical.
36 Rule 1304. Introduction of Committee Bills and Resolutions. A

1 committee may introduce bills and resolutions while the Legislature is in
2 session respecting any matters referred to it. Requests for introduction of
3 bills made before a committee shall be made by a legislator or a person,
4 state or local agency, organization or entity. A legislator whose purpose
5 is to request introduction of a bill on behalf of a person, state or local
6 agency, organization or entity shall state such purpose when making the
7 request. All requests for introduction, when approved by the committee,
8 shall be recorded in the minutes. Unless approved by the Speaker, a
9 standing committee may introduce bills and resolutions only within the
10 general subject area assigned to the committee. No standing committee
11 shall originate a bill which is substantially identical with any bill which
12 has been referred to another standing committee, and which is under
13 consideration by such committee.
14 Rule 1306. Voting in Committees. (a) The vote on any action taken
15 by a committee shall be recorded in the committee minutes. Any vote to
16 recommend amendments to a bill that strike all of the material in the bill
17 subsequent to the enacting clause and insert new material shall be a roll-
18 call vote and recorded in the committee minutes.
19 (b) All final actions by a committee shall be taken at a called
20 meeting while the Legislature is in session. Final action shall be taken on
21 any bill for which a motion has been approved by a two-thirds vote of the
22 members of the committee to consider such action on the bill. The final
23 action taken along with each individual member's vote shall be recorded
24 in the committee minutes. An individual member's vote may be recorded
25 at the member's request.
26 (b)(c) The committee chairperson may vote but shall not be required
27 to vote unless the committee is equally divided. If the chairperson's vote
28 makes the division equal, the question shall be lost.
29 (c)(d) An action formally taken by a committee cannot be altered in
30 the committee except by reconsideration and further formal action of the
31 committee.
32 (d)(e) A motion to take from the table may be adopted by the
33 affirmative vote of a majority of the members present at any called
34 meeting of the committee.
35 Rule 1307. Procedure in General. Committee procedure shall be
36 informal, but where any questions arise thereon, the rules or practices of
37 the House are applicable except that the right of a member to speak to any
38 question shall not be subject to the limitations prescribed by Rule 1704.
39 All motions in a committee shall require a second. Adjournment of a
40 committee requires a motion to adjourn, a second and the affirmative
41 vote of a majority of the members present.
42 Rule 3903. Showing Committee Amendments. (a) All bills and
43 resolutions reported by a committee with recommendation for

1 amendments and to be passed as amended shall be reprinted.
2 (b) When a committee recommends amendments to a bill that strike
3 all of the material in the bill subsequent to the enacting clause and insert
4 new material, the reprinted bill shall contain a notation specifying: (1)
5 The committee that recommended the amendment or amendments; (2) the
6 date the amendment or amendments were recommended; and (3) the bill
7 number of the source bill or bills, if any, that included the inserted new
8 material to the underlying bill pursuant to the amendment or
9 amendments. Additionally, the source bill or bills shall be reprinted with
10 a notation specifying the bill to which the material from the source bill
11 was inserted pursuant to an amendment as described in this subsection.
12 Rule 3906. Committee of the Whole Amendments. (a) If a bill or
13 concurrent resolution is amended by the Committee of the Whole, it shall
14 be reprinted showing the amendments.
15 (b) When the Committee of the Whole recommends amendments to a
16 bill that strike all of the material in the bill subsequent to the enacting
17 clause and insert new material, such reprinted bill shall contain a
18 notation specifying: (1) The member that offered the amendment or
19 amendments; (2) the date the amendment or amendments were
20 recommended; and (3) the bill number of the source bill or bills, if any,
21 that included the inserted new material to the underlying bill pursuant to
22 the amendment or amendments. Additionally, the source bill or bills shall
23 be reprinted with a notation specifying the bill to which the material from
24 the source bill was inserted pursuant to an amendment as described in
25 this subsection.
26 Be it further resolved: That Rule 2110 be revoked.
