SUBJECT: Fiscal Note for HB 2040 by Representative Carmichael
In accordance with KSA 75-3715a, the following fiscal note concerning HB 2040 is
respectfully submitted to your committee.
HB 2040 would amend workers compensation law by changing language related to the
cause of injury due to drug or alcohol impairment from “conclusively presumed” to “a rebuttable
presumption.” The bill would also remove marijuana from the list of drugs subject to testing.
According to the Kansas Department of Labor, HB 2040 would have no fiscal effect on the
Workers Compensation Program. The Department of Administration indicates the bill would have
no fiscal effect on the State Self Insurance Fund.
