Dear Representative Tarwater:
SUBJECT: Fiscal Note for HB 2017 by Representative Carmichael
In accordance with KSA 75-3715a, the following fiscal note concerning HB 2017 is
respectfully submitted to your committee.
Under current law, workers compensation benefits are disallowed if an employee’s injury
is from the employee’s voluntary participation in fighting or horseplay with a co-employee for any
reason, work related or otherwise. HB 2017 would specify that an employee would be disqualified
from workers compensation benefits if the injury results from nonwork-related fighting or
horseplay. The bill would also clarify language regarding workers compensation benefits and
retirement benefits provided by employers.
According to the Kansas Department of Labor, HB 2017 would have no fiscal effect on the
Workers Compensation Program. Also, the Department of Administration indicates the bill would
have no fiscal effect on the State Self Insurance Fund.
