SUBJECT: Fiscal Note for HB 2472 by House Committee on Corrections and Juvenile
Justice
In accordance with KSA 75-3715a, the following fiscal note concerning HB 2472 is
respectfully submitted to your committee.
HB 2472 would amend the “2003 SB 123 Substance Abuse Treatment Program” by
expanding court ordered placement of offenders in certified drug abuse treatment programs to
certain persons who enter into a diversion agreement in lieu of further criminal proceedings.
The Kansas Sentencing Commission estimates HB 2472 could increase the number of
offenders sentenced to mandatory drug treatment in the “2003 SB 123 Drug Treatment Program”
by 30 to 90 offenders beginning in FY 2021, which would increase program costs from the State
General Fund by a minimum of $94,290 and up to $282,870. The Commission indicates this
estimate is based on the average cost of treatment per offender of $3,143 in FY 2019. The
Commission indicates HB 2472 could result in additional prison admissions and prison beds, but
a fiscal effect cannot be estimated. The Kansas Department of Corrections indicates HB 2472
would increase the number of offenders supervised by Community Corrections, but a fiscal effect
cannot be estimated. Any fiscal effect associated with HB 2472 is not reflected in The FY 2021
Governor’s Budget Report.
