SUPPLEMENTAL NOTE ON HOUSE BILL NO. 2464

Brief*
HB 2464 would clarify the Kansas Egg Law regarding
repacked eggs (Note: Repacking eggs means removing a
broken or dirty egg from a carton and replacing it with an
unbroken and clean egg as long as certain requirements in
current law are met.)
The bill would clarify which requirements would need to
be met for repacked eggs to be graded Grade B and which
requirements would need to be met to repack eggs to be
graded higher than Grade B.
The bill would replace the word “repackaged” with
“repacked” and make technical changes.

Background
The bill was introduced by the House Committee on
Agriculture at the request of a representative of Walmart.
In the House Committee hearing, the Deputy Secretary
of the Kansas Department of Agriculture (KDA) and a
representative of Walmart provided proponent testimony on
the bill, stating the bill would clarify amendments to the
Kansas Egg Law that were added in 2018 regarding the
requirements of repacking eggs of certain grades by retailers.

The House Committee amended the bill by adding
clarifying language suggested by the Office of Revisor of
Statutes.
According to the fiscal note prepared by the Division of
the Budget on the bill as introduced, the KDA indicates
enactment of the bill would have no fiscal effect on agency
operations.
