SUBJECT: Fiscal Note for HB 2434 by Representative Finney
In accordance with KSA 75-3715a, the following fiscal note concerning HB 2434 is
respectfully submitted to your committee.
HB 2434 would revoke the authority to suspend driving privileges for the nonpayment of
fines from traffic citations or court costs associated with a traffic citation.
The Office of Judicial Administration estimates enactment of HB 2434 would reduce
revenues to the Judicial Branch Nonjudicial Salary Adjustment Fund. Since the bill specifies that
failure to pay fines and court costs would no longer be a basis for suspension of a person’s driver’s
license, there would be fewer people who have their driver’s license suspended, which would cause
a decrease in revenue to the Judicial Branch Nonjudicial Salary Adjustment Fund. Because the
fund is used to pay a portion of nonjudicial salaries, the Office states it would have to reduce staff
or find an alternative funding source to pay salaries. However, a fiscal effect cannot be estimated.
The Kansas Department of Revenue estimates that revoking the authority to suspend
driving privileges for nonpayment of fines from traffic citations would result in a decrease of
$483,346 in revenue to the Division of Vehicles. The decrease is estimated from the average of
nonpayment of fines of $19,335 per year. The Department estimates additional State General Fund
expenditures of $2,900 would be required in FY 2021 for changes to the agency’s information
technology equipment. Any fiscal effect associated with HB 2434 is not reflected in The FY 2021
Governor’s Budget Report.
