SUBJECT: Fiscal Note for HB 2435 by Representative Pittman
In accordance with KSA 75-3715a, the following fiscal note concerning HB 2435 is
respectfully submitted to your committee.
Under current law, individuals permitted to pay off a fine through community service
receive credit at a rate of $5 per hour. HB 2435, as introduced, would allow individuals to receive
credit toward such fines in the amount of the minimum wage set by KSA 44-1203(a) for each full
hour of community service.
The League of Kansas Municipalities indicates that enactment of HB 2345, as introduced,
would result in a negligible fiscal effect on local governments that could be absorbed within
existing resources.
The Kansas Association of Counties indicates that revenues received by counties through
court fines could decrease and expenditures that are currently offset by community service hours
could increase as individuals would be able to pay off more fines in a shorter amount of time.
However, the fiscal effect cannot be estimated because the number of fines and community service
hours are unknown.
The Office of Judicial Administration and the Department of Corrections indicate that
enactment of the bill would have no fiscal effect on the agencies. Any fiscal effect associated with
HB 2435 is not reflected in The FY 2021 Governor’s Budget Report.
