SUPPLEMENTAL NOTE ON HOUSE BILL NO. 2429

Brief*
HB 2429, as amended, would amend law relating to the
Kansas Criminal Justice Reform Commission (Commission)
and the Kansas Cold Case Task Force (Task Force).

Kansas Criminal Justice Reform Commission
The bill would add a public defender voting member to
the Commission; this public defender would be appointed by
the State Board of Indigents’ Defense Services (BIDS).
The bill would also authorize members of the
Commission who are not legislators or public employees to
receive mileage, tolls, and parking as provided in continuing
law, for attendance at any meeting of the Commission or
Commission subcommittee. The bill would define “public
employee” for this purpose to mean an employee of the State
of Kansas; any employee of an incorporated city; or any
employee of a county, township, school district, or other
political subdivision of the State.

Kansas Cold Case Task Force
The bill would amend law related to the Task Force
regarding staffing and the expiration of the Task Force. The
bill would require staff of the Office of Revisor of Statutes,
Legislative Research Department, and Division of Legislative

Administrative Services to provide assistance to the Task
Force as requested by the co-chairs of the Task Force. The
bill would also make a technical correction.

Background
HB 2429 was prefiled for introduction by
Representatives Owen and Finney. In the House Committee
on Corrections and Juvenile Justice hearing, a representative
of the Kansas Association of Criminal Defense Lawyers
testified in support. Written proponent testimony was provided
by Representative Owens. No other testimony was provided.
The House Committee amended the bill to specify the
public defender member be appointed by BIDS; insert the
contents of HB 2471 relating to payment of mileage, tolls, and
parking for Commission members who are not legislators or
public employees; and add provisions regarding staffing of
the Task Force.
According to the fiscal note prepared by the Division of
the Budget on the bill as introduced, BIDS stated enactment
of the bill could result in the agency incurring travel costs
such as a rental car if the appointed public defender works in
an office outside of the Topeka area. However, BIDS
estimated the costs would be negligible and could be
absorbed within existing resources. The Department of
Corrections anticipated enactment of the bill would have no
fiscal effect on the agency. Any fiscal effect associated with
enactment of the bill is not reflected in The FY 2021
Governor’s Budget Report.

HB 2471 (Mileage, Tolls, and Parking Reimbursement)
HB 2471 was introduced by the House Committee on
Corrections and Juvenile Justice at the request of
Representative Jennings.

At the House Committee hearing, written proponent
testimony was provided by Representative Jennings.
According to the fiscal note prepared by the Division of
the Budget, enactment of HB 2471, as introduced, would
increase costs for reimbursement of travel and subsistence
by $7,189 from the State General Fund in FY 2021 for the
five members of the Commission who are not legislators or
public employees.
Any fiscal effect associated with enactment of HB 2471
is not reflected in The FY 2021 Governor’s Budget Report.
