SUBJECT: Fiscal Note for HB 2384 by House Committee on Taxation
In accordance with KSA 75-3715a, the following fiscal note concerning HB 2384 is
respectfully submitted to your committee.
HB 2384 would amend existing law concerning the Kansas State Board of Cosmetology to
require all actions of the Board to be conducted in accordance with the Kansas Administrative
Procedure Act and reviewable in accordance with the Kansas Judicial Review Act. Costs assessed
with regard to an administrative hearing against professions regulated by the Board would be paid
by the party to the proceeding if the Board is the prevailing party and by the Board if it is not. The
bill would allow any person to apply to the Board for a charitable event or demonstration permit
and would establish a fee for each type of permit. The bill would establish the requirements to
obtain reinstatement for any licensee of the Board whose license has been expired for more than
six months and would require a reinstatement fee of $125. The bill would remove the requirements
that Board licensees be graduates of accredited high schools or have held a current license in
another state for not less than ten years prior to the date of application.
Under the provisions of the bill, a person who is scheduled to take a license examination
could be issued a temporary permit to practice cosmetology by the Board, and the permit would
expire six weeks after the originally scheduled examination date. The bill would require apprentice
licenses to be displayed in a conspicuous location in any licensed school or electrology school,
clinic and establishment. Schools licensed by the Board that enroll students to practice as
apprentices would be required to pay the Board a fee and obtain an apprentice license for each
student not more than 15 days after the student’s enrollment in the school.

The Kansas Board of Cosmetology expects that enactment of HB 2384 would result in
increased expenditures of approximately $5,280 and increased revenues of approximately the same
amount. Any fiscal effect associated with HB 2384 is not reflected in The FY 2020 Governor’s
Budget Report.
