SUPPLEMENTAL NOTE ON SENATE BILL NO. 205

Brief*
SB 205, as amended, would amend law related to
administration of the Kansas Charitable Gaming Act (Act).
Continuing law requires the Secretary of Revenue (Secretary)
to designate an administrator of charitable gaming
(Administrator) who is responsible for administration and
enforcement of the Act.
The bill would amend provisions regarding the
Administrator’s duties by removing a requirement that
administration and enforcement of the Act be the exclusive
duties of the Administrator. The bill would also remove a
requirement the Administrator be solely accountable to the
Secretary.

Background
The bill was introduced by the Senate Committee on
Federal and State Affairs at the request of the Department of
Revenue (Department).
During the Senate Committee hearing, proponent
testimony was provided by a representative of the
Department, who indicated the purpose of the legislation is to
allow other Department employees to fill the role of the
Administrator when the position is vacant.
No other testimony was provided.

The Senate Committee amended the bill by removing
language that would have allowed the Secretary to appoint an
employee of the Department as an Interim Administrator.
Additionally, the Senate Committee removed language in
current law requiring the Administrator’s duties be exclusive
and a requirement the Administrator be solely accountable to
the Secretary.
According to the fiscal note prepared by the Division of
Budget on the bill, as introduced, the Department indicates
enactment of the bill would have no fiscal effect.
