Dear Representative Waymaster:
SUBJECT: Fiscal Note for HB 2377 by House Committee on Federal and State Affairs
In accordance with KSA 75-3715a, the following fiscal note concerning HB 2377 is
respectfully submitted to your committee.
HB 2377 would exempt nonprofit charitable organizations, participating licensed
optometrists, ophthalmologists or any trained volunteers working with the organizations from
being held liable for any damages or injuries resulting from the performance of any vision
screening or the provision of donated or recycled eyeglasses under certain circumstances identified
in the bill. The exemption from liability would not include damages or injuries resulting from
gross negligence or willful misconduct. The bill would also define “nonprofit charitable
organization” and “vision screening.”
Kansas Board of Examiners in Optometry indicates enactment of HB 2377 would have no
fiscal effect on the Board.
