SUBJECT: Fiscal Note for HB 2374 by House Committee on Appropriations
In accordance with KSA 75-3715a, the following fiscal note concerning HB 2374 is
respectfully submitted to your committee.
Under current law, the Attorney General is authorized to provide an award of up to $5,000
to a person who provides information concerning violations of the Medicaid Fraud Control Act,
False Claims Act or any other provision of law that protects the integrity of the public treasury.
HB 2374 would require the Attorney General to award 10.0 percent of any recovery to a person
who is an original source of such information. The bill would also specify that individuals would
not be entitled to an award if a court finds that they planned or initiated the conduct giving rise to
the violation.
The Office of the Attorney General indicates that enactment of HB 2374 could encourage
more reporting and increase the amount of recoveries and rewards paid. However, the agency
notes it has not issued an award under current statute since its enactment. The fiscal effect on the
agency cannot be estimated because the number of potential violations and awards is unknown.
The Office of Judicial Administration and the Kansas Department of Health and Environment
indicate that enactment of the bill would have no fiscal effect. Any fiscal effect associated with
HB 2374 is not reflected in The FY 2020 Governor’s Budget Report.
