SUBJECT: Fiscal Note for HB 2358 by House Committee on Health and Human Services
In accordance with KSA 75-3715a, the following fiscal note concerning HB 2358 is respectfully
submitted to your committee.
HB 2358 would require the Board of Pharmacy, Board of Nursing, Board of Healing Arts and
the Board of Veterinary Examiners to adopt rules and regulations for imposing requirements to prescribe
opioid drugs. The bill would require all prescribers of opioid drugs to discuss any relevant risks and
recommendations related to an opioid drug with the patient. All prescribers would be required to
complete three hours of continuing education for each license renewal regarding opiate situations and
one hour of continuing education regarding the Prescription Drug Monitoring Program.
The Board of Nursing indicates that HB 2358 would require a revision to some regulations and
estimates the cost of the revisions and publication to be less than $5,000. The Board of Veterinary
Examiners indicates the bill would add to the responsibilities of 1.00 Inspector FTE position within the
agency and it may need to increase fees and staff. The Board of Pharmacy indicates that the bill would
require short-term costs including researching opiate and narcotic prescribing guidelines and drafting
regulations. The Board anticipates that it would incur expenditures of $130,840. These expenditures
would include $103,000 for inspections and drafting of rules and regulations and $27,840 for vehicle
costs and other operating expenditures. The Board of Healing Arts indicates that the Board would need
an additional 1.00 FTE Legal Assistant FTE position to research and assist with drafting of rules and
regulations. Salary, fringe benefits and other operating expenditures associated with the new position
would total $57,483 for FY 2020. Any fiscal effect associated with HB 2358 is not reflected in The FY
2020 Governor’s Budget Report.
