SUBJECT: Fiscal Note for HB 2339 by House Committee on Health and Human
Services
In accordance with KSA 75-3715a, the following fiscal note concerning HB 2339 is
respectfully submitted to your committee.
HB 2339 would update the Naturopathic Doctor Licensure Act. The bill would expand
naturopathic doctors’ scope of practice to include ordering diagnostic imaging studies, prescribing
drugs and medical devices, and performing minor office procedures. The bill would designate
naturopathic doctors as mid-level practitioners.

The Kansas Board of Healing Arts states that the bill would require the agency to research
and draft new rules and regulations. The Board further states that enactment of HB 2339 would
result in additional reports and complaints regarding practitioners alleged to have violated the law.
In order to conduct the resulting investigations and disciplinary actions, an additional 3.00 FTE
positions would be required including 1.00 FTE Legal Assistant position, 1.00 FTE Investigator
position, and 1.00 FTE Senior Administrative Assistant position. The Board estimates annual
salary expenditures for the new positions of $155,000. Annual additional operating costs for

phone, email, and internet access are estimated at $3,600. One-time costs in FY 2020 of $21,000
for furniture and equipment, $1,260 for public hearing and publication costs, and $1,000 for
creating applications and forms would also be required. The total estimated cost for
implementation of the bill would be $181,860 in FY 2020 and $158,600 in subsequent years. Any
fiscal effect associated with HB 2339 is not reflected in The FY 2020 Governor’s Budget Report.
