SUBJECT: Fiscal Note for HB 2330 by House Committee on Education
In accordance with KSA 75-3715a, the following fiscal note concerning HB 2330 is
respectfully submitted to your committee.
HB 2330 would require each local board of education to adopt a policy to prohibit bullying,
harassment or cyberbullying on school premises, in a school vehicle or during a school-sponsored
activity or event whether on or off school premises. Any policy adopted shall be written through
a process that includes representation of parents, school district administrators, teachers, and other
employees, school district volunteers, students and members of the community.
The State Board of Education would be required to develop a model policy applicable to
kindergarten and grades one through 12. The model policy would include an age-appropriate range
of consequences for bullying, harassment or cyberbullying that would include disciplinary action
or counseling as appropriate under the circumstances. The model policy would be provided to
school districts on or before September 1, 2019.
On or after November 1, 2019, each local board of education would be required to revise
its policy on bullying, harassment or cyberbullying and transmit a copy to the State Board of
Education. Each school year, the local board of education would be required to conduct a review
and evaluation of the policy and make any necessary revisions. The district would be required to
transmit a copy of any revised policy to the State Board of Education within 30 days after its
adoption.

According to the Department of Education, enactment of HB 2330 would require the State
Board of Education to convene a 15-member committee to develop the model bullying policy that
would meet twice. The cost of this committee would be $3,000 in FY 2020 (15 members X $100
per meeting X 2 meetings = $3,000.) Any costs to implemental local school district policies would
be borne by the local boards of education within existing budget resources. Any fiscal effect
associated with HB 2330 is not reflected in The FY 2020 Governor’s Budget Report.
