Dear Representative Jennings:
SUBJECT: Fiscal Note for HB 2299 by Representative Holscher, et al.
In accordance with KSA 75-3715a, the following fiscal note concerning HB 2299 is
respectfully submitted to your committee.
HB 2299 would amend the list of mitigating factors that a court may consider for a
departure sentence. The list would consider a mitigating factor if the victim was an aggressor or
participant in the criminal conduct associated with the crime of conviction. The bill clarifies that
a victim of a sex offense, human trafficking or aggravated human trafficking, or incest or
aggravated incest, who is under the age of 16 must not be considered an aggressor or participant
in the criminal conduct.
The Office of Judicial Administration indicates any fiscal effect associated with the
passage of HB 2299 would be negligible. The Kansas Sentencing Commission indicates HB 2299
could result in additional prison beds, but a precise fiscal effect cannot be determined.
