SUBJECT: Fiscal Note for HB 2189 by Representative Parker
In accordance with KSA 75-3715a, the following fiscal note concerning HB 2189 is
respectfully submitted to your committee.
Current law concerning elections requires each judge of an election to challenge a person
offering to vote when the judge knows or suspects that person is not qualified as an elector. To
the list of persons who would be considered qualified electors but should be challenged and entitled
to cast a provisional ballot, the bill would add a person who has moved to a different county in
Kansas. Current law allows a person who has moved from the address on the registration book to
another address within the county and has not registered at the new address to vote a provisional
ballot or apply for an advance voting ballot after completing an application for registration. HB
2189 would provide the same voting rights to a person who has moved from another address within
another county in Kansas. When a county election officer reregisters a registered voter from
another county, the officer would be required to notify the officer of the other county so that the
person’s name could be deleted from that county’s registration book.
According to the Secretary of State, enactment of HB 2189 would require the agency to
update training and educational materials to reflect the changes made by the bill at an estimated
cost of $20,000 or less in each of the next two fiscal years. The agency indicates that this could
be accomplished within existing resources. The agency notes that it is a long-standing
administration policy in all 105 counties to issue a provisional ballot to any person who appears at
a polling place on Election Day. Although this bill adds a new category of provisional ballot
recipients, it is not expected to increase the number of provisional ballots that are issued. It will,
however, change how provisional ballots are categorized and processed. The Kansas Association
of Counties states that the cost of categorizing and processing the additional provisional ballots

would be negligible. Any fiscal effect associated with HB 2189 is not reflected in The FY 2020
Governor’s Budget Report.
