SUBJECT: Fiscal Note for HB 2192 by House Committee on Judiciary
In accordance with KSA 75-3715a, the following fiscal note concerning HB 2192 is
respectfully submitted to your committee.
HB 2192 would add the nomination of persons to serve as judges of the Court of Appeals
to the duties of the Supreme Court Nominating Commission. When a vacancy occurs on the Court
of Appeals, the Clerk of the Supreme Court would notify the chairperson of the Commission. The
chairperson would convene a meeting of the Commission to nominate individuals for appointment
to the Court of Appeals. The Governor would have 60 days to make an appointment from the
nominees submitted by the Commission. If the Governor does not make the appointment within
60 days, the Chief Justice of the Supreme Court would make the appointment. The bill would also
set out the process of the Commission for future vacancies and the causes for which a nominee
may withdraw.
The Office of Judicial Administration indicates because the number of required
Commission meetings varies based on the number of open positions, a fiscal effect cannot be
estimated. Any fiscal effect associated with HB 2192 is not reflected in The FY 2020 Governor’s
Budget Report.
