SUBJECT: Fiscal Note for SB 117 by Senate Committee on Agriculture and Natural
Resources
In accordance with KSA 75-3715a, the following fiscal note concerning SB 117 is
respectfully submitted to your committee.
SB 117 would establish the procedures that must be followed when the Animal Health
Commissioner determines that a quarantine or other regulations are necessary to prevent the spread
of a contagious or infectious diseases among dogs and cats. The bill would establish the
requirements for owners of dogs or cats affected with a contagious or infectious disease or
currently under treatment by a licensed veterinarian for such a disease, with certain exceptions
specified by the bill. The bill would prohibit a person who has a dog, cat or ferret that is under
rabies observations, is the subject of a state or local quarantine order or has not received
vaccinations, from allowing the animal to run at large or from moving, transferring, or transporting
the animal. The bill would prohibit any person from bringing or transporting a dog or cat into the
state without first having the animal inspected and passed under certificate of health. The Animal
Health Commissioner could impose a civil penalty in the amount of not less than $250 and not
more than $1,000 for each violation of the act, and in the case of a continuing violation, every day
that the violation continues would be deemed a separate violation. Existing law concerning
quarantine of domestic animals would specifically exclude dogs and cats. The bill would provide
definitions of terms used within the bill and would remove cats and dogs from the list of “all kinds
of domestic animals” contained in current statutes concerning livestock and domestic animals.

According to the Kansas Department of Agriculture, enactment of SB 117 would have no
fiscal effect on agency expenditures or revenues. The requirement that inspectors check
paperwork for animal movement is already being performed by the agency.
