SUBJECT: Fiscal Note for HB 2152 by House Committee on Judiciary
In accordance with KSA 75-3715a, the following fiscal note concerning HB 2152 is
respectfully submitted to your committee.
HB 2152 would provide that a person with a disability may submit a request for a
reasonable accommodation to maintain an assistance animal on the landlord’s property pursuant
to the Fair Housing Act, or any other federal, state, or local law. If the person making the request
has a disability or disability-related need for an assistance animal that is not readily known or
apparent to the landlord, the landlord may require the person to produce documentation of the
disability or disability-related need for the assistance animal. The bill would establish
requirements that would have to be met in order for the person to receive a reasonable
accommodation. A landlord would not be liable for damages or injuries caused by a person’s
assistance animal that is permitted on the landlord’s property as a reasonable accommodation.
The Office of Judicial Administration indicates enactment of HB 2152 would have a
negligible effect on the operations of the Judicial Branch.
