SUBJECT: Fiscal Note for HB 2156 by House Committee on Agriculture
In accordance with KSA 75-3715a, the following fiscal note concerning HB 2156 is
respectfully submitted to your committee.
HB 2156 would amend the Kansas Pesticide Law to make it unlawful for any person to
provide an inspection report regarding the presence or absence of wood-destroying pests, unless
the person is certified and licensed under the statutory requirements for the category of industrial,
institutional, structural and health-related pest control and the sub-category of wood-destroying
pests.

According to the Kansas Department of Agriculture, enactment of HB 2156 would result
in additional expenditures for the agency of $226,949 to hire 2.00 Compliance Assistant FTE
positions to track and monitor property sales relating to termite and pesticide application. In
addition, the agency would be required to hire 1.00 Attorney I FTE positions to process penalties
and sanctions for those not in compliance with the provisions of the bill. Because the bill does not

provide a source of revenue to offset these costs, the agency would need to request additional
expenditures from the State General Fund. Any fiscal effect associated with HB 2156 is not
reflected in The FY 2020 Governor’s Budget Report.
