1 AN ACT concerning education; relating to the instruction and financing
2 thereof; making and concerning appropriations for the fiscal years
3 ending June 30, 2020, and June 30, 2021, for the department of
4 education.

6 Be it enacted by the Legislature of the State of Kansas:
7 Section 1.
8 DEPARTMENT OF EDUCATION
9 (a) There is appropriated for the above agency from the state general
10 fund for the fiscal year ending June 30, 2020, the following:
11 Special education
12 services aid (652-00-1000-0700)........................................$585,784,772
13 Provided, That any unencumbered balance in the special education
14 services aid account in excess of $100 as of June 30, 2019, is hereby
15 reappropriated for fiscal year 2020: Provided further, That expenditures
16 shall not be made from the special education services aid account for the
17 provision of instruction for any homebound or hospitalized child, unless
18 the categorization of such child as exceptional is conjoined with the
19 categorization of the child within one or more of the other categories of
20 exceptionality: And provided further, That expenditures shall be made from
21 this account for grants to school districts in amounts determined pursuant
22 to and in accordance with the provisions of K.S.A. 72-3425, and
23 amendments thereto: And provided further, That expenditures shall be
24 made from the amount remaining in this account, after deduction of the
25 expenditures specified in the foregoing provisos, for payments to school
26 districts in amounts determined pursuant to and in accordance with the
27 provisions of K.S.A. 72-3422, and amendments thereto.
28 Sec. 2.
29 DEPARTMENT OF EDUCATION
30 (a) There is appropriated for the above agency from the state general
31 fund for the fiscal year ending June 30, 2021, the following:
32 Special education
33 services aid (652-00-1000-0700)........................................$617,431,038
34 Provided, That any unencumbered balance in the special education
35 services aid account in excess of $100 as of June 30, 2020, is hereby
36 reappropriated for fiscal year 2021: Provided further, That expenditures

1 shall not be made from the special education services aid account for the

12 provisions of K.S.A. 72-3422, and amendments thereto.
13 Sec. 3. This act shall take effect and be in force from and after its
14 publication in the statute book.
