SUBJECT: Fiscal Note for HB 2132 by House Committee on Corrections and Juvenile
Justice
In accordance with KSA 75-3715a, the following fiscal note concerning HB 2132 is
respectfully submitted to your committee.
Under current law, certain types of lewd and lascivious behavior committed in the presence
of a person 16 years of age or older is a class B nonperson misdemeanor. HB 2132 would change
the penalty for certain types of lewd and lascivious behavior, as defined in the bill, to a severity
level ten, person felony, while other types of lewd and luscious behavior would remain a class B
nonperson misdemeanor.
The Office of Judicial Administration indicates enactment of HB 2132 would have a
negligible effect on the operations of the Judicial Branch.
The Kansas Sentencing Commission estimates enactment of HB 2132 have no immediate
effect on prison beds or admissions. Any fiscal effect associated with HB 2132 is not reflected in
The FY 2020 Governor’s Budget Report.
