SUBJECT: Fiscal Note for HB 2090 by Representative Clayton, et al.
In accordance with KSA 75-3715a, the following fiscal note concerning HB 2090 is
respectfully submitted to your committee.
HB 2090 would require the Secretary of State to develop a voter registration program to
offer voter registration services through the Kansas Department for Children and Families, the
Kansas Department for Aging and Disability Services, and the Kansas Department of Labor. This
program would offer applicants for services the opportunity to register to vote. The Secretary of
State would also be required to work with the Kansas State Department of Education to develop a
voter registration program to offer voter registration services at each accredited high school in
Kansas. The bill would also require the Kansas Department of Corrections to offer inmates the
opportunity to register to vote at the time of discharge. The bill would amend existing law
concerning voting without being qualified to specify that a person who is ineligible to vote and
who becomes registered to vote under the provisions of this bill, in the absence of willful
misrepresentation, would be presumed to be not at fault and would not be subject to criminal
prosecution.

According to the Secretary of State, enactment of HB 2090 would result in expenditures to
develop training and education materials for each agency specified in the bill, as well as for every
high school in the state. Education materials would also need to be provided to the general public.
The Secretary of State would also need to update the statewide voter registration database to track
and provide statistical information relating to the sources of these new registrations. The agency

estimates expenses of $65,000 in FY 2020 with long-term expenses of $50,000 to $100,000
annually. The agency assumes that the Kansas Department for Children and Families, the Kansas
Department for Aging and Disability Services, the Kansas Department of Corrections, and the
Kansas State Department of Education would also experience additional costs associated with
enactment of this bill.
According to the Kansas Department of Labor, enactment of HB 2090 would result in the
need for programming of the current Victor system and its website to incorporate a question as to
whether the individual would like to register to vote at the end of the benefit application process,
but anticipates that any expense incurred could be absorbed within existing resources.
The Kansas Department for Children and Families indicates that KSA 25-2303 includes
state agencies that provide public assistance in the definition of voter registration agencies, and
thus, the agency currently offers voter registration services to persons applying for assistance that
would satisfy the requirements of HB 2090. The Kansas Department for Aging and Disability
Services indicates that enactment of HB 2090 could cause additional expenditures for the agency;
however, it is unable to estimate what those expenditures might amount to. It is likely that this
agency is already providing the services required by HB 2090 as it also meets the definition of a
voter registration agency contained in KSA 25-2303. The Kansas State Department of Education
reports that enactment of HB 2090 would result in no additional expenditures for the agency. The
Kansas Department of Corrections did not respond to a request for information on the fiscal effect
of enactment of HB 2090. Any fiscal effect associated with HB 2090 is not reflected in The FY
2020 Governor’s Budget Report.
