1 A PROPOSITION to amend article 11 of the constitution of the state of
2 Kansas by adding a new section thereto, concerning the state highway
3 fund in the state treasury.

5 Be it resolved by the Legislature of the State of Kansas, two-thirds of
6 the members elected (or appointed) and qualified to the Senate and two-
7 thirds of the members elected (or appointed) and qualified to the House
8 of Representatives concurring therein:
9 Section 1. The following proposition to amend the constitution of
10 the state of Kansas shall be submitted to the qualified electors of the state
11 for their approval or rejection: Article 11 of the constitution of the state of
12 Kansas is hereby amended by adding a new section thereto to read as
13 follows:
14 "ยง 14. State Highway Fund. (a) On and after July 1, 2021,
15 moneys shall be appropriated, expended or transferred from the
16 state highway fund that is established and maintained in the state
17 treasury only as follows:
18 (1) To cities on the state highway system for transportation
19 projects;
20 (2) for the construction, improvement, reconstruction and
21 maintenance of the state highway system;
22 (3) for improvements in transportation programs to aid elderly
23 persons, persons with disabilities and the general public;
24 (4) for any purpose specified pursuant to a comprehensive
25 transportation program;
26 (5) for the support and maintenance of the department of
27 transportation;
28 (6) for the expenses of administering the motor vehicle
29 registration and drivers' license laws; and
30 (7) for the payment of losses to department of transportation
31 employees authorized pursuant to law.
32 (b) Under no circumstances shall moneys be transferred from
33 the state highway fund or appropriated or expended from the state
34 highway fund for any purpose not provided for in this section.
35 (c) The legislature may enact laws to carry out the purposes of
36 this section."

1 Sec. 2. The following statement shall be printed on the ballot with
2 the amendment as a whole:
3 "Explanatory statement. The purpose of this amendment is to
4 prevent transfers and limit expenditures from the state highway
5 fund to only those items related to transportation set forth in the
6 amendment.
7 "A vote for this amendment would provide that moneys credited to
8 the state highway fund would only be used for those purposes
9 set forth in the amendment as prescribed by law.
10 "A vote against this amendment would make no changes in current
11 law concerning the state's finances."
12 Sec. 3. This resolution, if approved by two-thirds of the members
13 elected (or appointed) and qualified to the Senate, and two-thirds of the
14 members elected (or appointed) and qualified to the House of
15 Representatives shall be entered on the journals, together with the yeas
16 and nays. The secretary of state shall cause this resolution to be published
17 as provided by law and shall cause the proposed amendment to be
18 submitted to the electors of the state at the general election in the year
19 2020 unless a special election is called at a sooner date by concurrent
20 resolution of the legislature, in which case it shall be submitted to the
21 electors of the state at the special election.
