HOUSE CONCURRENT
RESOLUTION No. 14
1 A CONCURRENT RESOLUTION to address inequities in
2 voting.
3 Whereas, Article 1, Section 23 of the Constitution of the State
4 of Indiana clearly specifies that "The General Assembly shall
5 not grant to any citizen, or class of citizens, privileges or
6 immunities, which, upon the same terms, shall not equally
7 belong to all citizens";
8 Whereas, The Fourteenth Amendment to the Constitution of
9 the United States clearly specifies that "No State shall...deny to
10 any person within its jurisdiction the equal protection of the
11 laws";
12 Whereas, Article 1, Section 25 of the Constitution of the State
13 of Indiana specifies that "No law shall be passed, the taking
14 effect of which shall be made to depend upon any authority,
15 except as provided in this Constitution;
16 Whereas, The Indiana Code subsumes itself under both state
17 and federal constitutions in IC 1-1-2-1;
18 Whereas, IC 3 has over time created special classes of
19 citizens, with a hierarchy of ballot access and political
20 affiliation rules, varying privileges, limitations, or immunities,
21 which, upon the same terms, do not equally belong to all
22 citizens;
23 Whereas, Examples of special class of citizens, privileges, or
24 immunities, which upon the same terms, do not equally belong
25 to all citizens are found in IC 3-5-1-2, IC 3-5-2-5.5,

1 IC 3-5-2-30, IC 3-5-3-7, IC 3-6-4.1-2, and IC 3-10-1-2; and
2 Whereas, These special classes of citizens with hierarchical
3 rights, privileges, limitations, and immunities that are present
4 under IC 3 violate state and federal constitutional rule of law:
5 Therefore,
6 Be it resolved by the House of Representatives
7 of the General Assembly of the State of Indiana,
8 the Senate concurring:
9 SECTION 1. That the general assembly recognizes both the
10 errors made, and the damages caused, by past legislation.
11 SECTION 2. That the general assembly resolves to remedy
12 violations of individual rights and transgressions of
13 constitutional rule of law present under IC 3 by appropriate
14 legislation.
