SENATE RESOLUTION ____
MADAM PRESIDENT:
I offer the following resolution and move its adoption:
1 A SENATE RESOLUTION urging the legislative council
2 to study the issue of creating a defense to possession of
3 marijuana and marijuana paraphernalia.
4 Whereas, Thirty-three states and the District of Columbia
5 have legalized marijuana usage for the purpose of medical
6 treatment under the recommendation of a physician;
7 Whereas, Medical marijuana treatment provides healing,
8 pain relief, and other medical benefits for individuals suffering
9 from terminal illnesses or otherwise untreatable diseases;
10 Whereas, Individuals who have received a recommendation
11 from a physician and obtained unexpired, legal credentials to
12 possess and use medical marijuana in another state should
13 have a valid defense in Indiana to possess less than two ounces
14 of marijuana, an instrument or device used in conjunction with
15 marijuana, or both;
16 Whereas, Individuals should not fear arrest and
17 prosecution for treating their serious or terminal illness with
18 medical marijuana that has been certified as legal in their
19 home state; and

1 Whereas, Creating a defense to possession of marijuana for
2 individuals with a valid medical marijuana recommendation
3 from a physician from another state will encourage tourism to
4 Indiana without fear of repercussions for engaging in necessary
5 medical treatment: Therefore,
6 Be it resolved by the Senate of the
7 General Assembly of the State of Indiana:

9 SECTION 1. That the Indiana Senate urges the legislative
10 council to assign to the appropriate study committee the topic
11 of creating a defense to possession of marijuana and marijuana
12 paraphernalia.
