Summary of Legislation: This bill requires a physician to obtain informed consent and provide certain
information to a patient before performing a hysterectomy or an oophorectomy.
Effective Date: July 1, 2021.
Explanation of State Expenditures: A violation of the bill’s requirements would be subject to
administrative orders and procedures by the Medical Licensing Board and the Professional Licensing Agency
(PLA). The nature of the violation and the corrective actions of the physician will determine the cost to PLA.
Additionally, PLA would likely need to notify license holders of the requirements established by the bill and
post updates to the PLA website. These actions are within the PLA’s routine administrative functions and
should be able to be implemented with no additional appropriations.
Explanation of State Revenues: Upon violation of the bill’s requirements by a physician, the Medical
Licensing Board may revoke or suspend the physician’s license or assess a maximum fine of $1,000 to be
deposited in the General Fund. A license revocation or suspension would result in a decrease in revenue to
the General Fund in the amount of $200 biennially. Any impact on General Fund revenue is expected to be
minimal.
