Summary of Legislation: This bill authorizes a county legislative body to adopt an ordinance prohibiting
a registered sex offender from establishing a domicile in the county, unless the county was the person's
county of residence at the time the person committed the sex offense.
Effective Date: July 1, 2021.

Explanation of Local Expenditures: Any added expenses for the county will depend on whether the county
legislative body (generally county councils) adopts such an ordinance and whether registered sex offenders
violate the ordinance.
If a person violates the ordinance, an attorney representing the county, city, or town may file a civil action
to enforce compliance. If the governmental entity prevails, it is entitled to recover reasonable attorney's fees
incurred in bringing the action. If a defendant in the case prevails, the defendant is entitled to reasonable
costs and attorney's fees incurred in defending the action. Courts should be able to dispose any civil actions
with existing resources.
Explanation of Local Revenues: Local units may impose fines for violating ordinances of not more than
$2,500 for a first violation of the ordinance and not more than $7,500 for a second or subsequent violation
of the ordinance. Any proceeds from fines collected would most likely to deposited into the general fund of

the political subdivision.
