Summary of Legislation: The bill requires a health care provider, when providing treatment to a minor for
alcoholism, alcohol abuse, drug abuse, or a venereal disease, to make a reasonable effort to contact the
minor's parent or guardian to provide information on the minor's condition and proposed treatment and to
document in writing each attempt the health care provider makes to contact the parent or guardian of the
minor.
Effective Date: July 1, 2021.
Explanation of State Expenditures: The bill will have increased workload for the Division of Mental
Health and Addiction’s providers and other providers reimbursed through Medicaid. The fiscal impact is
dependent on the number of instances where notification is needed and the amount of time required to notify
parents. The bill does not require parental consent, only a reasonable effort to notify parents or guardians.
Explanation of State Revenues:
Explanation of Local Expenditures: Local health services providers, such as Community Mental Health
Centers or locally owned hospitals, may have workload increases to make reasonable effort to contact a
minor’s parent or guardian.
Additional Information - In an advisory to all providers, Indiana University Health indicated that “reasonable
effort” includes asking the patient about their parents or guardians and documenting attempts to reach parents
or guardians if the patient cannot be encouraged to make the contact on their own.
