Summary of Legislation: The bill provides that the gender listed on an individual's birth certificate and
permanent record made from the birth certificate may not be changed. It specifies certain exceptions.
Effective Date: July 1, 2021.
Explanation of State Expenditures:
Explanation of State Revenues: The Indiana State Department of Health (ISDH) currently charges $18 in
fees to issue amended birth certificates. Any reduction in fee revenue as a result of this bill will likely be
minimal.
Explanation of Local Expenditures: Current ISDH policy requires a court order for a change of gender
on Indiana birth certificates. Any reduction in workload for local courts or clerk’s offices as a result of
prohibiting birth certificate gender changes will likely be minimal.
