Summary of Legislation: This bill waives court costs and fees associated with the kinship care of a minor.
Effective Date: July 1, 2021.
Explanation of State Expenditures:
Explanation of State Revenues: Summary - To the extent a relative providing kinship care to a minor is
subject to court costs or fees as a result of a juvenile delinquency or child in need of services (CHINS)
proceedings, the bill will reduce revenue to the state General Fund, State User Fee Fund, county general
fund, the clerk record perpetuation fund, and all other associated funds or programs.
It is unknown how many relatives providing kinship care to minors in juvenile delinquency or CHINS cases
are subject to court costs or fees. In November 2020, there were about 16,553 CHINS around the state. Of
16,553 CHINS, 5,794 were placed in a relative’s home.
Additional Information - The bill provides that the clerk shall not waive the payment of court costs or fees
if the proceeding is a result of the inability, refusal, or neglect of the adult providing kinship care to the minor
to supply the minor with necessary food, clothing, shelter, medical care, education, or supervision.
