BILL NUMBER: HB 1441 BILL AMENDED: Mar 22, 2021
SUBJECT: Full Faith and Credit for Tribal Court Orders.
FIRST AUTHOR: Rep. DeLaney BILL STATUS: Enrolled
FIRST SPONSOR: Sen. Brown L
FUNDS AFFECTED: X GENERAL IMPACT: State & Local
X DEDICATED
X FEDERAL
Summary of Legislation: This bill requires that, under certain circumstances, a court of record in Indiana
shall give full faith and credit to judgments and orders of a tribal court affiliated with the Pokagon Band of
Potawatomi Indians.
Effective Date: July 1, 2021.
Explanation of State Expenditures:
Explanation of State Revenues: The bill’s provisions will have an indeterminate fiscal impact. To the
extent full faith and credit are reciprocated by a tribal court affiliated with the Pokagon Band of Potawatomi
Indians, the bill could potentially increase enforcement of court orders and collection of court fines and fees.
The bill would likely have a very minimal fiscal impact concerning federal incentive payments for child
support collections. Indiana may receive additional incentive funds to the extent collection rates improve.
