Summary of Legislation: The bill requires the Office of the Secretary of Family and Social Services (FSSA)
to extend the time in which a provider has to file a timely reimbursement claim when providing services
under the fee-for-service Community Habilitation and Family Supports Medicaid waiver (waiver).
The bill also prohibits the FSSA from establishing or otherwise requiring ratios for the number of individuals
to be provided day habilitation services in a group setting for reimbursement under the waiver.
Effective Date: Upon passage; March 1, 2020 (retroactive).
Explanation of State Expenditures: The bill requires the FSSA to apply to the federal government for state
waiver amendments. Applying for a waiver amendment is within the FSSA’s routine administrative functions
and should be able to be implemented with no additional appropriations, assuming near customary agency
staffing and resource levels. An amendment to the waiver would not change Medicaid expenditures until
after federal approval is received and the impact of these changes is indeterminate.
Additional Information - During the pandemic emergency, timely claim filing was extended from 90 days
to 180 days past the date of service under an 1135 Flexibility Waiver. The bill would require 365 days for
timely filing under a future disaster emergency for certain waiver programs.
Day habilitation reimbursement is currently based on the number of group members per provider (ratios).
A repeal of ratios would impact future reimbursement.
